Re:  Your Agreement with New York Surf Soccer Club, Inc.


Dear Mr. Vittorato:


I am the legal counsel to New York Surf Soccer Club Inc. (the “Club”).  I was asked to review your agreement with the Club dated March 25, 2017 (the “Agreement”) in order to advise the Club of its contractual rights and your obligations as the Director of the NY Surf Futsal Academy and as a coach in the Club.  


The Agreement is in the nature of a personal services contract, which emphasizes your requirement to conduct yourself at all times in a professional and loyal manner that reflects positively onto the Club and enhances its reputation.  Your obligations include, but are not limited to, the following:


  • Adherence to the Club’s code of conduct as a coach (Article 4);

  • Non-solicitation of the Club’s customers (players), coaches and support staff (Article 7); and

  • Avoiding all potential conflict of interest and/or engaging in any activity that might interfere with the proper and efficient performance of your obligations as the Director of the NY Surf Futsal Academy and as a coach in the Club (Article 11).

The Club believes that you breached your obligations under the Agreement. More specifically:

  • You did not schedule, setup, oversee and execute specific outdoor foot skills camps and futsal clinics this Summer and Fall;

  • You are not organizing coaches and futsal curriculum;

  • You are not taking steps to prepare for the upcoming winter 2017-2018 ten (10) week competitive season;

  • You are not preparing for the NY Surf Futsal Tournament scheduled for winter 2017-2018;

  • You are engaging in activities which are in violation of including Section 7 of the Agreement;

  • You are engaging in activities which are in violation of including Section 11 of the Agreement, including

    • Providing services to other soccer clubs in violation of the Agreement, including to Levittown Soccer Club, East Meadow Soccer Club and Dix Hills Soccer Club.
    • Operating and marketing DV Futsal Academy in direct competition with NY Surf Futsal Academy; and

  • You have made slanderous remarks about the Club
  • You have caused significant financial damages to the Club

You are advised to take immediate steps to cure all of your defaults under Agreement as enumerated above, and unless you provide the Club with written confirmation of each of the steps that you have taken to cure such defaults within a period of 5 days, the Club will have no choice but to purse its legal and contractual rights and remedies.

You obviously don't know the man. He is a fantastic coach. I know that most parents don't wan to here this, but if you kid has no talent and is not willing to put in the extra time not even Jill Ellis can help. I've said it before and I will say it again. If the the only time your kid picks up a soccer ball is on their way to practice just stink with your town team

Yes he coaches 2 teams that a parent put together so he could plow down every obstacle for his 2 kids who I am told are heavily favored but they have very limited abilities. There are only 2 teams at this club in two age groups I think and both are trained by Danillo who is one of the more overrated trainers and overpriced. Daddy ball club is not relevant as they have a dad running things to fit the needs of his two kids and they are trained by none other than Danillo. Not a great combination. To add to all this the dad was responsible for poaching most the kids on these teams from the East Islip soccer program that his two children played on.

you don't know what you are talking about. the teams are mixed with kids from different towns. Yes there are some EI kids on it. This is old news, why bring this stuff up now? if people are happy there, and they are leave it alone. Obviously you have a axe to grind.

While not a fan of poaching teams. What teams does East Islip still have that are legitimate? They are hemorraging kids because leadership from board to DOC is horrible. Except for 2-3 trainers its a mess, and those trainers can only do so much with handcuffs on. How did magical Slammers partnership work out? Girls side has been utter failure. SUSA in their backyard and never stepped up their game. Take care of kids/families and maybe they wont leave. Only thing they have done amazingly right is Just for Kicks.

Executive Soccer Academy (ESA) is the "made up club". It is real, but has maybe only 2 teams as prior poster mentioned. I know of only one, we have played a G2010 team, Forza. That used to be the East Islip Red Stars until the 2021-2022 season when their admin took that team "private" (this was the EI "A" team in that age group that was pretty successful), probably for the benefit of his kid. Maybe he gets some kind of business tax write off for doing so LOL.

The Forza team is quite successful, they probably still maintain some loose relationship with East Islip becasue of their origin. They are competitive in the National Conference Division 1. I have seen Danilo in action coaching that team, and I think he seems to be a good supportive type of a coach. I would not hesitate to have my kid tryout for that team if I was looking, but maybe they are not even looking....

Just to correct my own post above, ESA is Eastern Soccer Academy, not executive. They have the G2010 team I wrote about and they have a B2010 team that plays division 1 in the NYCS-EDP North Atlantic league. Still pretty successful if you ask me as someone who has nothing to do with this "club".
